ORDINANCE NO. 5900
AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING FOR WASTEWATER PIPELINE REPAIRS AND REHABILITATION PROJECT, PHASE II, AWARDING A CONTRACT TO HELLER COMPANY; AND FOR OTHER PURPOSES.
WHEREAS, Ark. Code Ann. §14-58-303, §14-47-138 and City of Hot Springs, Arkansas, Ordinance No. 5387 of 2005 provide that the City may, by ordinance waive the requirements of competitive bidding in exceptional situations where such procedure is deemed to not be feasible or practicable; and that
WHEREAS, pursuant to Resolution No. 7807 Heller Company is currently under contract for Phase I of the Wastewater pipeline repairs rehabilitation project, and
WHEREAS, additional work within the project scope has been identified, and the contractor has agreed to honor Phase I unit pricing for Phase II work, thus allowing the City to realize savings in both time and cost; and that
WHEREAS, city staff and the consulting engineer recommends awarding a contract to Heller Company for said project.
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Hot springs, Arkansas, as follows:
That it is hereby found and determined that it is not feasible or practicable to require competitive bidding for wastewater pipeline repairs and rehabilitation project. Therefore, the requirement of competitive bidding with respect to the procurement of said services, is hereby waived; and the City of Hot Springs, by and through its authorized agents, is hereby authorized to award Phase II of the Wastewater Pipeline Repair and Rehabilitation Project contract to Heller Company, Inc., of Hot Springs, Arkansas, for said project in an amount not to exceed of $416,602 paid from the proceeds of the 2009 Wastewater Bond Issue.
