ORDINANCE NO. 5903
AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING FOR THE PURCHASE OF CERTAIN REAL PROPERTY, TEMPORARY CONSTRUCTION EASEMENTS AND DRAINAGE EASEMENTS RELATED TO THE HIGDON FERRY WIDENING PROJECT- PHASE III- PRINTERS PLACE TO CRAWFORD AVENUE (AHTD JOB# 061214) AND FOR OTHER PURPOSES.
WHEREAS, Ark. Code Ann. §14-58-303, §14-47-138 AND City of Hot Springs, Arkansas Ordinance No. 5387 of 2005 provided that the City may, by ordinance, waive the requirements of competitive bidding on exceptional situations where such procedure is deemed to not be feasible or practicable; and that
WHEREAS, it is necessary to acquire certain real property, temporary construction easements and Drainage Easements for Phase III of the widening of Higdon Ferry Road (AHTD Job# 061214) that includes the stretch of roadway from Printers Place to Crawford Avenue.
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Hot Springs, Arkansas, as follows:
That is hereby found and determined that it is not feasible or practicable to require competitive bidding for the purchase of certain real property, temporary construction easements and drainage easements related to Phase III of the widening of Higdon Ferry Road (AHTD Job# 061214) that includes the stretch of roadway from Printers Place to Crawford Avenue. Therefore, the requirements of competitive bidding, with respect to the procurement of said real property and temporary construction easement, are hereby waived; and the City of Hot Springs, by and through its authorized agents, is hereby authorized to purchase the following real property and temporary construction easements in amounts not to exceed those listed in the following table, plus applicable closing costs.
