ORDINANCE NO. 5906
AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING FOR THE PROCUREMENT OF CERTAIN SOLE- SOURCE EQUIPMENT - ELECTRONIC CONTROL DEVICES AND ACCESSORIES (TASERS FOR THE POLICE DEPARTMENT), APPROVING SOLE- SOURCE SUPPLIER TEECO SAFETY; AND FOR OTHER PURPOSES.
WHEREAS, Ark. Code Ann. §14-58-303, §14-47-138 and City of Hot Springs, Arkansas, Ordinance No. 5387 of 2005 provide that the City may, by ordinance, waive the requirements of competitive bidding in exceptional situations where such procedure is deemed to not be feasible for practicable; and that
WHEREAS, the Police Department desires to purchase electronic control devices and equipment which must be compatible with Taser brand devices and equipment already in use; and
WHEREAS, Teeco Safety is the sole distributor of Taser brand equipment for the State of Arkansas; therefore, negating the ability to competitively bid their products.
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Hot Springs, Arkansas, as follows:
SECTION 1. It is hereby found and determined that is it not feasible or practicable to require competitive bidding for the purchase of certain electronic control devices and accessories, which are sole source items must be procured from the equipment manufacturer through the authorized distributor, Teeco Safety. Therefore, the requirements of competitive bidding with respect to the procurement of electronic control devices and accessories, are hereby waived; and the City of Hot Springs, by and through its authorized agents, is hereby authorized to engage Teeco Safety, as the sole-source supplier of electronic control devices and accessories.
SECTION 2. Provided further, with the exception of receipt of competitive bids or quotes, all of the purchasing procedures shall be followed; and any single such procurement, which exceeds $20,000, shall be approved by the Board of Directors.
