ORDINANCE NO. 5904
AN ORDINANCE AMENDING THE ZONING CODE OF THE CITY OF HOT SPRINGS, ARKANSAS (ORDINANCE 5158, AS AMENDED), BY AMENDING SECTION 16-2-109 CLEAR VISIBILITY AT INTERSECTIONS IN RESIDENTIAL DISTRICTS; AND FOR OTHER PURPOSES.
WHEREAS, the Hot Springs Zoning Code (Ordinance 5158, as amended), as codified in Hot Springs Code of Ordinances in Section 16-2-109, includes “Clear Visibility at intersections in residential districts.” thereby imposing regulations specific to such use activities; and
WHEREAS, District 1 Director Peggy Maruthur initiated an amendment according to Hot Springs Zoning Code Section 16-2-11(a)(2)(a); and
WHEREAS, the Hot Springs Planning Commission, at its legally advertised public hearing held on October 11, 2012, has recommended that this Zoning Code amendment be approved and that the same appears to be in the interest of the City of Hot Springs, Arkansas.
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Hot Springs, Arkansas:
Section 1. That the Zoning Code of the City of Hot Springs, Arkansas (Ordinance 5158, as amended), is hereby further amended by amending Section 16-2-109 to read:
16-2-109. Clear visibility at intersections.
On any corner lot nothing shall be erected, placed, planted, or allowed to grow in such a manner as materially to impede vision between a height of 3 1/2 feet and 10 feet above the center line grade of the intersecting street in the area bounded by the street right-of-way lines (not curb lines but the rights-of-way lines which are also the property lines) of such corner lot and a line joining points along said streets rights-of-way lines 25 feet from the point of intersection. The following graphic illustrates this requirement.
Section 2. This ordinance shall be codified in the City of Hot Springs Code of Ordinances and the sections may be renumbered or re-lettered to accomplish such intention.
