ORDINANCE NO. 5907
AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE BIDDING FOR THE PROCUREMENT OF IN-CAR VIDEO EQUIPMENT FROM TSCWARE, INC; AND FOR OTHER PURPOSES.
WHEREAS, Ark. Code Ann. §14-58-303, §14-47-138 and City of Hot Springs, Arkansas, Ordinance No. 5389 of 2005 provide that the City May, by ordinance waive the requirements of competitive bidding in exceptional situations where such procedure is deemed to not be feasible for practicable; and that
WHEREAS, TCSWare, Inc has installed all equipment and accessories relevant for fully functioning in-car audio/video recording systems in 51 vehicles; and
WHEREAS, the Hot Springs Police Department has received grants funds in the amount of $43,369, which will cover costs for 7 additional vehicles be outfitted with complete recording systems; and that
WHEREAS, to ensure compatibility throughout the fleet and maintain equipment consistency, identical systems are necessary in all vehicles.
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Hot Springs, Arkansas, as follows:
It is hereby found and determined that is it not feasible or practicable to require competitive bidding for the purchase of in-car video equipment. Therefore, the requirements of competitive bidding for said in-car video equipment are hereby waived; and the City of Hot Springs, by and through its authorized agents, is hereby authorized to procure said in-car video equipment from TCSWare, Inc., in an amount not to exceed $43,369 for calendar year 2012.
