ORDINANCE NO. 5975
AN ORDINANCE AUTHORIZING AN AGREEMENT FOR DETENTION SERVICES BY AND BETWEEN THE CITY OF HOT SPRINGS, ARKANSAS AND GARLAND COUNTY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, at a special election held on October 11, 2011, the citizens of Hot Springs and Garland County approved a 0.375% sales and use tax to operate and maintain detention facilities and to pay the costs of housing prisoners as well as a 0.625% sales and use tax for the construction of a new detention center (jail) ; and that
WHEREAS, Arkansas law (A.C.A. § 26-74-414 (b)) dictates that the revenue from any such O&M tax must be shared with the City of Hot Springs on a per capita population basis; and that
WHEREAS, the City and County acknowledge that the new detention center (jail) should be viewed as a facility operated for the general benefit of residents of Garland County including those who reside within the City of Hot Springs;
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Hot Springs, Arkansas, as follows:
SECTION 1. Agreement. The Detention Services Agreement by and between Garland County and the City of Hot Springs, Arkansas (City), attached hereto and incorporated herein by reference, is hereby approved. The Mayor and the City Clerk are hereby authorized and directed to execute same on behalf of the City.
SECTION 2. Repealer. That all ordinances and resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 3. Emergency Clause. The proper care and housing of prisoners arrested by the Hot Springs Police Department being of significant concern to the City of Hot Springs, Arkansas, the Board of Directors finds that an emergency exists and this Ordinance shall, therefore, take effect immediately upon its passage and approval.
