IN THE CIRCUIT COURT OF GARLAND COUNTY, ARKANSAS. ARVEST MORTGAGE COMPANY, PLAINTIFF, vs. DONALD D. COOPER III, TRISHA L. COOPER, ARVEST BANK, and TENANTS OF 301 STONEHURST ROAD, HOT SPRINGS, AR, IF ANY, DEFENDANTS.
NOTICE IS GIVEN that in pursuance of the authority contained in the decretal order of Garland County Circuit Court entered on the 12th day of June, 2009, in Case No. CV 2009-622-2 then pending herein between Arvest Mortgage Company, Plaintiff, and Donald D. Cooper III, et al., Defendants, the undersigned, as Commissioner of said Court, will offer for sale at public venue to the highest bidder, at the Main Entrance of the County Courthouse, 501 Ouachita Avenue, Hot Springs, Arkansas, in which said Court is held, in the County of Garland, City of Hot Springs, Arkansas, within the hours prescribed by law for judicial sales at 11:00 a.m. on Wednesday the 15th day of July, 2009, the following described real estate, situated in Garland County, Arkansas, to wit:
LOT 27 AND THE E 1/2 OF LOT 28 OF CRESTMONT SUBDIVISION, UNIT #2, ACCORDING TO THE AMENDED PLAT RECORDED IN BOOK 3 AT PAGE 41 OF THE PLAT RECORDS OF GARLAND COUNTY, ARKANSAS. (hereinafter the “Property”). (a/k/a 301 Stonehurst Road, Hot Springs, AR).
TERMS OF SALE: On a credit of three months, the purchaser being required to execute a bond as required by law and the order and decree of said Court in said cause, with approved security, bearing interest at the rate of 10.0 percent per annum from date of sale until paid, and a lien being retained on the premises sold to secure the payment of the purchase money.
