Man allegedly assaults girlfriend, her son

A reportedly intoxicated Hot Springs man was arrested Friday evening after allegedly assaulting his girlfriend and her son at their residence.

Donald Eugene Smith, 39, who lists a West St. Louis address, was taken into custody shortly before 7:30 p.m. and charged with two misdemeanor counts of third-degree domestic battery, punishable by up to one year in jail, second-degree criminal mischief and public intoxication.

Smith, who also had warrants for failure to appear and failure to comply, remained in custody Monday on zero bond and is set to appear Aug. 22 in Garland County District Court.

According to the affidavit, Hot Springs police Officer 1st Class Rod West responded to a disturbance at Smith's residence and spoke to Smith's girlfriend who said she, her son and Smith got into a fight a few minutes earlier.

She said she and Smith had argued in the living room regarding a rude comment Smith reportedly made about her daughter when "without warning" Smith pushed her, knocking her to the floor while screaming obscenities at her.

She said she got up and yelled at Smith to get out of the house and when he left she closed the door behind him. She said he started banging on the door and cursing at her demanding to be let in. She said he finally forced the door open, damaging the door frame, and pushed her to the floor again.

Then he allegedly got on top of her and punched her several times in the head as she was screaming for help. Her son ran into the living room and upon seeing Smith hitting his mother screamed at him to get off.

Then her son began punching Smith in the face until Smith slapped him on the right shoulder. Smith got off his girlfriend and ran outside where he grabbed an alternator off the ground and smashed it through the windshield of a red 2000 Dodge parked outside.

The affidavit notes the girlfriend was complaining of pain in her neck, legs, shoulders and right forearm. West noted visible swelling to her right hand and fingers, a cut to her forearm and an abrasion to her knee. He also noted redness to her son's shoulder.

Smith had left the residence when West arrived, but he was located at the corner of Helen and Summer streets and taken into custody. West noted Smith had lacerations on both sides of his face.
