Suspect faces additional charges following arrest

A partially clothed man who was arrested on felony drug charges in the 3100 block of Central Avenue early the morning of Aug. 11 now faces an additional charge of tampering with physical evidence.

Brannon Beau Nixon, 38, who lists a Prospect Avenue address, was taken into custody at around 6:30 a.m. Aug. 11 and charged with two counts of possession of drug paraphernalia, each punishable by up to six years in jail, and a misdemeanor count of public intoxication.

Nixon, who remained in custody Wednesday in lieu of $2,500 bond, is set to appear Sept. 25 in Garland County District Court.

The additional charge followed a review of in-vehicle video taken while Nixon was en route to the Garland County Detention Center, which showed Nixon removed a white plastic bag from his sock.

He reportedly checked to make sure the arresting officer was not watching too closely, popped the bag into his mouth for lubrication, then inserted the bag into a body cavity, according to the probable cause affidavit.

The investigator said he believed the unidentified substance was most likely heroin or methamphetamine, due to the fact Nixon went through such extraordinary measures to conceal the bag.

According to the original affidavit, police responded to the 3100 block of Central Avenue in reference to a man "acting crazy and flopping around" in the parking lot. They found Nixon walking around the parking lot clothed only in his underwear and moving "very sporadically."

Nixon reportedly had red, bloodshot eyes, extremely small pupils and was unsteady on his feet. When officers asked him why he did not have pants on, he allegedly asserted, "I do have pants on." After he looked down, he reportedly said, "I have no idea how they came off."

The affidavit said that, due to his level of impairment, Nixon was determined to be an annoyance to the shoppers in the area and was taken into custody for public intoxication.

As he was being placed into the patrol unit, he reportedly told officers, "take care of my guitar for me." Officers observed a guitar case on the ground about 20 feet away.

Officers searched the guitar case and surrounding area, and reportedly discovered two used syringes which they believed Nixon was using to inject meth intravenously.
