Man arrested for allegedly shoving 74-year-old neighbor off porch

A Hot Springs man was arrested on a felony battery charge for allegedly shoving his 74-year-old neighbor off the porch during an argument Saturday evening.

Rickey O. Hall, 47, of 167 Amity Road, was taken into custody at his residence shortly before 6 p.m. and charged with second-degree battery, punishable by up to six years in prison. He remained in custody Monday in lieu of $2,500 bond and was set to be arraigned Monday afternoon in Garland County District Court.

According to the affidavit, shortly after 5:30 p.m., Garland County sheriff's Deputy Justin Parker responded to a disturbance at the residence between two men and upon arrival made contact with the alleged victim sitting on the porch.

Parker noted the man "appeared to be very frail and had great difficulty standing" and was unable to stand "without shaking and the use of a crutch." The man stated his neighbor, identified as Hall, had approached him and engaged him in an argument.

He said Hall then shoved him, causing him to fall off the porch. Parker noted the man had a bloody abrasion to his right forearm, an abrasion to his left forearm and a bump on the left side of his forehead. The man was complaining of "extreme pain" to his back, but refused medical attention.

Parker spoke to Hall who allegedly stated, "he pushed me" and "he's f - - - - - - - ugly!" and claimed "I barely touched him." Parker noted Hall had no visible injuries. Hall said he had been living next door to the victim for more than 20 years and admitted he knew the victim had just returned home from having back surgery.

Under Arkansas law, a person commits felony battery if they purposefully cause physical injury to any person who is 60 years of age or older or 12 years of age or younger.
