Jessieville man charged with third DWI

A Jessieville man was arrested on multiple charges Thursday, including driving while intoxicated, his third offense, after allegedly driving recklessly and causing a rollover wreck on Highway 7 north while under the influence.

David Allan Johnson, 48, who lists a Joshua Circle address, was taken into custody shortly after 8 p.m. Thursday and charged with misdemeanor counts of DWI 3, reckless driving, driving on a suspended driver's license, refusal to submit to a chemical test, violation of a driver's license restriction (interlock device), and failure to maintain control of his vehicle.

Johnson remained in custody on a $3,000 bond and was set to appear Friday in Garland County District Court.

According to the probable cause affidavit, shortly after 7:30 p.m., Arkansas State Police Trooper Ryan Wingo was dispatched to a rollover accident on Highway 7 near Little Blakely Creek Road. A witness at the scene told the dispatcher that the driver, a male, and a female passenger were attempting to roll the vehicle back upright, blocking lanes of traffic while doing so.

The two were later identified as David Johnson and his wife, Debra Johnson, 45, both of Jessieville.

David Johnson told Wingo his wife was driving the vehicle when the steering wheel locked up and the vehicle went off into the ditch, causing it to roll onto the passenger side. Debra Johnson reportedly corroborated his statement.

Wingo informed David Johnson he knew he was the driver of the vehicle at the time, but he continued to deny it. Wingo placed took both of them into custody and questioned them separately.

After Wingo explained the consequences of making a false claim, David Johnson reportedly admitted he was the driver but refused to take a breathalyzer test. Debra Johnson submitted to a breathalyzer test which reportedly showed her blood alcohol content was over the legal limit.

Debra Johnson was charged with misdemeanor counts of public intoxication and obstructing government operations and later released on $1,000 bond. She is set to appear Sept. 10 in district court.

Deputies at the Garland County Detention Center conducted a field sobriety test on David Johnson, which reportedly showed eight clues he was intoxicated. He continued to refuse to submit to any chemical tests.

According to court records, David Johnson was previously convicted of DWI on Jan. 14 and on Feb. 14, both in Hot Springs. He reportedly had three previous DWI convictions, in 1996, 2000 and 2004.
