Man sentenced to prison for lawn mower thefts

A Hot Springs man was sentenced to four years in prison Monday after pleading guilty in Garland County Circuit Court to stealing five lawn mowers last year.

Toby Michael Green, 60, a previously convicted felon, pleaded guilty to theft of property more than $1,000 and in addition to prison time was ordered to pay $2,475 in restitution to the victims through a civil judgment.

According to the probable cause affidavit, on July 5, 2017, around 5:30 a.m., the owners of Parker's Country Corner, 2810 Highway 290, reported the theft of five lawn mowers from the business.

Garland County sheriff's Lt. Joel Ware and Investigator Charlie Mowery reviewed security video from the business and both recognized one of two men involved in the thefts as Green based on past dealings with him.

In the video, Green is seen pulling into the lot in a gray Mazda Tribute pulling a trailer. He and another known suspect get out and then Green is seen carrying bolt cutters and walks out of view of the camera. A few minutes later, Green is seen pushing lawn mowers across the lot to the trailer where he and the other man loaded them up.

After removing the mowers, with a total estimated value of $2,034, Green and the other man drive away. A warrant was issued for Green and he was arrested on July 18, 2017, and had remained in custody since then on zero bond.

Leslie Karen Davis, 60, who was set to stand trial April 18, pleaded guilty to a felony charge of possession of a controlled substance, meth, and a misdemeanor charge of possession of a controlled substance, marijuana, and in addition to probation was sentenced to 30 days in jail, fined $2,000 and ordered to pay $100 in court costs.

According to the probable cause affidavit, on June 27, 2017, Arkansas State Police Trooper 1st Class Brandon Margis was working patrol on Highway 270 east when he clocked a white sedan on radar doing 65 mph in a 50 mph zone and stopped it just west of Akers Road.

He determined the tags on the vehicle were fictitious and the driver, identified as Davis, had a suspended driver's license, so he called for the vehicle to be towed and did an inventory of the vehicle's contents.

He found two small clear baggies in the center console, one containing marijuana and the other containing what later tested positive for meth. Davis claimed the bags did not belong to her.

She was taken into custody and later released on $2,500 bond. She failed to appear for a hearing on Nov. 27, 2017, so her bond was revoked and a warrant was issued for her arrest. She was taken into custody again on Jan. 9, 2018, and had remained in custody since then.
