Sex offender sentenced to three years in prison

A previously convicted sex offender was sentenced to three years in prison Monday after he changed his address without notifying Hot Springs police last year.

Charles Julius Daggs, 25, pleaded guilty in Garland County Circuit Court to a felony charge of failure to comply with sex offender registration and reporting requirements with his three year sentence to run concurrently with the revocation of a suspended sentence from his conviction on Feb. 25, 2014, for fourth-degree sexual assault.

According to the probable cause affidavit on the failure to register charge, on Feb. 28, 2017, Daggs, who was classified as a level one registered sex offender, met with Detective Kenny May at the police department to fill out his registration and listed a Brenda Street address. He acknowledged he understood he had to report any change of address within three days of moving.

On April 23, 2017, Daggs was arrested on unrelated charges and listed a Walnut Street address. On April 25, May went to Daggs' previously listed address on Brenda Street and made contact with Daggs' mother. She said Daggs had moved from the residence to Walnut Street about a month earlier.

May went to the Walnut Street address and spoke with a woman who confirmed Daggs had been living there with her for about a month. May obtained a warrant for Daggs' arrest for failure to report and took him into custody on May 19, 2017.

Daggs' probation officer filed a petition to have Daggs' suspended sentence from 2014 revoked based on his arrest for failure to register, which violated the rule against breaking any laws, and because he had reportedly failed to pay any of the fines or court costs levied with his original conviction.

At the time of his conviction in 2014, in addition to the suspended sentence Daggs was ordered to pay a $500 fine and $970 in court costs and fees and had failed to make payments on any of them.

According to the affidavit on the sexual assault charge, on Jan. 8, 2013, a 15-year-old girl was interviewed at the Cooper-Anthony Mercy Child Advocacy Center after a complaint was filed by her mother regarding a sexual relationship she had been having with an adult male, identified as Daggs.

The victim had disclosed to her mother she had consensual sex with Daggs on several occasions beginning in May 2012 with the last incident occurring while she was on Christmas break on Dec. 28 at his apartment. On Jan. 24, Detective Sonja Luzader interviewed Daggs and he admitted to having sex with the victim on 10 different occasions while they were dating.

Luzader states she told Daggs to stay away from the victim but he was found in the victim's apartment on Jan. 29 and cited for criminal trespass.

The affidavit states between Oct. 31 and Dec. 28, 2012, while the suspect was 20 and the victim was 15 they engaged in sexual intercourse which qualifies as fourth-degree sexual assault based on their age difference.

A warrant for Daggs' arrest was issued through district court on Feb. 5, 2013, and he was arrested on Feb. 18, 2013. He was later released on $2,500 bond and pleaded guilty to the charge on Feb. 25, 2014.
