A Hot Springs man was arrested Sunday for allegedly shooting at and injuring his brother during a confrontation outside the man's apartment.

Lenon "Leo" Junior Hicks, 68, of 105 Lowery St., was taken into custody at his apartment around noon Sunday and charged with a felony count of aggravated assault, punishable by up to six years in prison, and a misdemeanor count of discharging a firearm in the city limits.

Hicks remained in custody Tuesday in lieu of $3,500 bond and is set to appear today in Garland County District Court.

According to the probable cause affidavit, Hot Springs police responded to the Lowery Street apartments to a report of shots fired and made contact with a witness who stated he heard a gunshot coming from building 700. He said he saw a tenant, identified as Hicks, yelling from the front of his apartment at an unknown man who was limping away.

The witness said the man got in the passenger side of a white Honda Civic and fled the area.

Officers made contact with Hicks and detained him. In searching his apartment to make sure it was clear, the officers reportedly found a .380-caliber handgun on a bed in the master bedroom in plain view.

When questioned later by Detective Jarrett Cantrell, Hicks reportedly stated his brother, 64, had come to his residence earlier "unannounced" and was banging on his door. When he opened it, his brother stepped inside "without permission" to ask him for money for cigarettes.

He said he told his brother to leave and when he refused he went to retrieve his gun. He said he walked back into the living room and his brother had stepped out on the threshold of the apartment. He said he followed him outside and again told him to leave.

When his brother refused to leave, Hicks allegedly stated he fired one shot at him. After he shot at him, he said his brother left in an unknown direction. Asked where he shot his brother at, Hicks reportedly said he "may have struck his right leg."

Officers reportedly found a spent shell casing on the ground about 10 feet from Hicks' front door and found blood on the ground near the parking spot where the brother got into the vehicle before leaving.

Cpl. Kirk Zaner said Tuesday officers did locate the brother and confirmed he had been shot in the leg, but he reportedly told police he didn't want to pursue charges.
