Homeless woman charged with prostitution, alleged client also faces charges

A reportedly homeless woman was arrested late Wednesday on a misdemeanor charge of prostitution after an alleged encounter with a local man who was also charged.

Kimberly Ann Garland, 47, who lists no permanent address, was taken into custody shortly before 11:30 p.m. at 126 Arkansas St. and charged with prostitution, punishable by up to 90 days in jail. She remained in custody Thursday in lieu of $750 bond and is set to appear today in Garland County District Court.

Also arrested was Carl Johnson, 71, of 126 Arkansas St., who was charged with misdemeanor counts of first-degree assault, punishable by up to one year in jail, and criminal solicitation, punishable by up to 90 days. He was released on citations and is set to appear Oct. 9 in district court.

According to the probable cause affidavit, shortly before 11 p.m., Hot Springs police responded to the residence on Arkansas Street to a reported disturbance involving Garland. Johnson told police Garland "would not leave his residence after he had paid her for sex."

Garland reportedly made unsolicited statements she came to Johnson's residence after speaking with him on the phone. She said she rode her bicycle to the residence and Johnson let her in. She said she told Johnson to take her to a convenience store to get a drink, cigarettes and chicken strips.

She said in exchange for the food and cigarettes and $45 she had agreed to engage in a sex act, which they did. She said he then asked if they could have sex and she refused. After she refused a second demand for a sex act, she alleges Johnson grabbed her by the throat and stated, "I'm not paying you the money!"

Once at the detention center, Garland reportedly told police Johnson had "short changed her $20" from a previous sex act and the food, cigarettes and drink and $45 were to cover the sex act she had performed that night.
