Third suspect in '18 drug raid pleads guilty, sentenced to probation in GC circuit court

The last of three suspects arrested early last year in a drug raid on their residence pleaded guilty Monday to a felony drug charge in Garland County Circuit Court.

Breauna Kristian Rose, 25, who lists a Humphreys Road address, appeared with her attorney, Brent Miller, and pleaded guilty to one count of possession of a controlled substance with purpose to deliver, marijuana, and was sentenced to three years' probation and ordered to pay $645 in court costs.

Additional felony counts of unauthorized use of another person's property to facilitate certain crimes, possession of a controlled substance with purpose to deliver, LSD, and possession of drug paraphernalia, were withdrawn.

Her sister, Maddison Lilyann Rose, 23, and her brother-in-law, Kyle Michael Johnston, 24, were arrested at the same time as Breauna Rose and each charged with a felony count of first-degree endangering the welfare of a minor, while Johnston was also charged with unauthorized use of another person's property and two counts of possession of drug paraphernalia.

Prosecutors amended the endangering charge from a felony to a misdemeanor on April 2, 2018, and after being continued multiple times both Maddison Rose and Johnston are set to stand trial March 23, 2019, but an agreement was reached that if they both stay out of trouble the charge will be withdrawn.

Johnston pleaded guilty Sept. 27, 2018, to two counts of possession of drug paraphernalia, amended from felonies to misdemeanors, and was sentenced to one year in jail on each count, all suspended, and ordered to pay $1,360 in court costs.

Miller, who also represented Maddison Rose and Johnston, said Tuesday, "In light of the various charges (Breauna Rose) faced, a fair disposition was reached in the case. With both co-defendants' matters addressed, they now can move forward a little less stressed."

According to the probable cause affidavit, on Jan. 31, 2018, the Hot Springs police Special Investigations-Narcotics Unit used the SWAT team to help serve a drug search warrant at the trio's Brown Street residence and located Breauna Rose in the sunroom, Maddison Rose in the master bedroom and Johnston in the rear bedroom holding a 10-month-old infant.

Investigators found a marijuana grinder and torch head on the kitchen table. In the sunroom, they found a pickle jar with 3.2 grams of what later tested positively for marijuana, a bag containing a Mason jar with 6.68 ounces of marijuana, a clear bag containing 44.7 grams of marijuana and a safe containing a glass jar containing 8.29 ounces of marijuana.

Investigators reportedly found seven dosage units of LSD, six rubber containers containing a yellow substance suspected to be 1.2 gram of DMT, a pint-size Mason jar containing THC oil and 32 grams of edible marijuana. Two pipes, digital scales, marijuana wax, other drug paraphernalia and $1,496 in cash were also found in the sunroom.

Investigators searched a shed in the back of the residence and found a plastic bag with 4.6 grams of marijuana and a red Toyota, which reportedly contained multiple bags with marijuana residue, two glass pipes and a child's pacifier with marijuana residue.

Investigators determined the residence, which belonged to another person, was less than 1,000 feet from Hot Springs School District bus routes and school bus stops and the drug paraphernalia was in public areas accessible to the infant living in the residence.

Maddison Rose said she was only aware of marijuana personally used by her husband in the residence. Johnston said he did not know of any drug sales from the residence, but admitted he kept some marijuana for personal use.

Breauna Rose said she had a bag in her room containing marijuana, scales and bags. She said there was a safe under her bed containing marijuana, a smoking device and a small amount of DMT. She reportedly said Johnston and her sister were unaware of the items in her room.
