Although three of the five members of the Hot Springs Board of Directors who considered a developer’s appeal Tuesday night for a six-lot subdivision voted to approve it, the measure failed to pass.

Initially noted that the appeal had been granted, City Attorney Brian Albright said after the meeting, “We messed up. The law requires a majority vote of the entire membership of the board, not just a simple majority of the members present.”
