Felon waving gun around while intoxicated sentenced to prison

A Hot Springs man with multiple prior felony convictions who was arrested last year after waving a gun around while intoxicated was sentenced to six years in prison Monday.

Doyle Scott Smith, 49, who lists a Panama Street address, pleaded guilty in Garland County Circuit Court to a felony count of possession of a firearm by certain persons while a misdemeanor charge of public intoxication was withdrawn and was sentenced to six years.

According to the probable cause affidavit, on March 31, 2018, around 2:15 a.m., Hot Springs police responded to the 3800 block of Central Avenue regarding a man waving a gun around and upon arrival found Smith with his hands raised in the air.

Smith was taken into custody and a Springfield .45-caliber handgun was located on his right rear hip. Officers noted Smith's speech was "extremely slurred and incoherent" and that he smelled strongly of alcohol.

A computer check revealed Smith had several prior felony convictions, including theft by receiving stemming from his arrest Jan. 12, 1994, in Hot Springs; carrying a prohibited weapon from an arrest May 14, 1998, in Hot Springs; felon in possession of a firearm from an arrest Jan. 12, 2001, in Fort Smith; felon in possession of a firearm from an arrest July 6, 2001, in Forrest City; and possession of a firearm by certain persons from an arrest March 15, 2013, in Hot Springs.

He was once placed on five years' probation and twice he was sentenced to five years in prison, with three years suspended, according to his bail determination form.
