Man arrested on felony battery charge following alleged assault

A local man was arrested on felony and misdemeanor charges Thursday morning after allegedly assaulting his live-in girlfriend for a second time despite a no-contact order issued against him.

Dustin Lee Ferguson, 28, of 234 Adcock Road, Apt. 1, was taken into custody at his residence shortly after 7:30 a.m. and charged with third-degree domestic battery, second offense, a felony punishable by up to six years in prison, and violation of a no-contact order, a misdemeanor punishable by up to one year in jail.

Ferguson was being held on $3,500 bond and was set to appear Friday in Garland County District Court.

According to the probable cause affidavit, shortly after 7 a.m. Thursday, Garland County sheriff's Deputy Lonnie Yarbrough was dispatched to the Adcock Road residence regarding a domestic disturbance and upon arrival, a woman, 31, came running out of the apartment screaming that Ferguson had hit her and put his hands around her neck.

Ferguson was detained at that time and dispatch informed Yarbrough that the woman had a no-contact order issued against Ferguson stemming from a disturbance between them on April 30.

The deputy noted the woman had red abrasions to her neck and shoulder allegedly from Ferguson putting his hands around her neck.

At that point, the woman told Yarbrough she didn't want to press charges and refused any medical attention.

Ferguson was previously arrested on April 30 for third-degree domestic battery involving the same victim and pleaded no contest to the charge on May 1 in district court. He was sentenced to one year in jail with all but two days suspended and ordered to pay $640 in fines and court costs.

Ferguson, who reportedly told Judge Joe Graham he would test positive for "speed and marijuana" used the day before, was also placed on six months probation during which he would be subject to random drug and alcohol testing and a court order barring him from contact with the victim was issued.

Based on his prior conviction, Yarbrough arrested Ferguson on a felony battery charge.
