Homeless man arrested after allegedly breaking into house, going to sleep

A reportedly homeless man was arrested late Tuesday inside a local woman's home after allegedly breaking in and going to sleep.

Charles Joseph Henderson, 29, who lists "city streets" as his address, was taken into custody shortly before 11:30 p.m. and charged with a felony count of breaking or entering, punishable by up to six years in prison, and a misdemeanor count of first-degree criminal mischief, punishable by up to one year in jail.

Henderson was being held on $3,500 bond and was set to appear via video Wednesday afternoon in Garland County District Court, but was reportedly removed from the video courtroom due to his behavior. His arraignment was rescheduled for Friday morning.

According to the probable cause affidavit, shortly after 11 p.m., Hot Springs police responded to a residence in the 100 block of Gibson Street regarding a break-in and spoke to the homeowner, who stated she had been away from the house for about four months, but returned to find the front door "busted open."

The owner also noted a side window was broken out with the total damages to the door and window estimated at about $600. She told officers no one was permitted to be on the property.

Officers approached the house and noted the front door was broken off its hinges with a large object placed on the other side to hold it closed. The officers went around to the east side of the house where the window was broken and discovered a side door that was cracked open.

Officer Matthew Cheatham pushed the door open and saw a man, later identified as Henderson, asleep on a mattress inside the house. He gave commands for Henderson to exit the house and he reportedly complied and was detained while officers checked the rest of the house.

Cheatham noted the house was "in a very diminished state" with "a great deal of damage" throughout and many items that appeared to be missing. The owner stated she wanted to press charges for the break-in and the damages caused.
