Man arrested for theft, resisting arrest after wrecking scooter

A Royal man was arrested Wednesday after allegedly wrecking a reportedly stolen scooter and resisting arrest.

Randal Grady Joe Fair, 27, who lists a Cleo Street address, was taken into custody near his home around 1 a.m. Wednesday and charged with a felony count of theft by receiving more than $1,000, punishable by up to six years in prison, and a misdemeanor count of resisting arrest, punishable by up to 90 days in jail.

Fair was initially held on $3,500 bond, but appeared via video Wednesday in Garland County District Court and pleaded not guilty to the charges. His bond was lowered to $2,500 and a felony review hearing to determine if the charges will be bound over to Garland County Circuit Court is set for Aug. 13. Fair remained in custody Wednesday afternoon.

According to the probable cause affidavit, Garland County sheriff's Deputy Stacy Morgan was dispatched to Cleo Street in reference to a report of two men fighting in the road near a motorcycle.

Morgan made contact with one man, identified as Fair, who was kneeling on the road next to a red, black and silver scooter.

Fair reportedly told the deputy he wrecked the scooter after he was chased by some stray dogs in the area. A computer search revealed the Honda scooter was reportedly stolen out of Hot Springs.

Morgan attempted to detain Fair, due to the stolen scooter, but he allegedly pulled away and said, "If you don't ease up I'm going to run." Fair continued to jerk his arms and kick his legs attempting to break free, Morgan said.

The deputy was finally able to pull Fair to the ground and call for backup. Fair allegedly continued to yell profanity at the deputy and when placed in the patrol unit began kicking and hitting his head against the inside of the vehicle.

Fair reportedly continued to yell, "(Expletive) you! Police brutality!" He later claimed he did not know the scooter was stolen and that he purchased it from a man who gave him a bill of sale but did not reveal the identity of the man.
