Woman charged with battery for allegedly kicking daughter

A Hot Springs woman was arrested on a felony battery charge Sunday evening after she allegedly kicked her daughter, who is under the age of 12, in the leg during a disturbance over child custody.

Chasity Danielle Harris, 38, of 398 Geronimo St., was taken into custody at her residence shortly before 5:30 p.m. and charged with second-degree domestic battery, punishable by up to 10 years in prison.

Harris, who lists no prior felony history, was being held on zero bond and was set to appear Monday in Garland County District Court.

According to the probable cause affidavit, Garland County sheriff's Deputies Stacy Morgan and Candice Stacks were dispatched to the Geronimo Street residence regarding "a child custody issue" and upon arrival noticed several people standing in the driveway.

Stacks spoke to a female witness who stated Harris was trying to take her four children back to her home at 398 Geronimo and at one point kicked her daughter on the leg.

Stacks spoke to the daughter who reportedly confirmed her mother had kicked her and showed her an abrasion on her right calf reportedly from the kick which Stacks photographed.

Deputies spoke to Harris who reportedly admitted to kicking her daughter, but claimed she had just kicked her "on the butt in a playful way" and "not out of anger." Stacks reportedly contacted the Department of Human Services and Arkansas Crimes Against Children to report the incident.

Harris was taken into custody at that point and the affidavit notes due to the alleged victim being under the age of 12 it was a felony battery charge. The report did not indicate if the victim had to be treated medically for the injury.
