Sex offender charged again with failing to register

A local man classified as a sex offender with multiple prior arrests for failing to register as required was arrested again early Sunday.

Toby Edward Carter, 53, who lists an address of 117 Kerry Lane, was taken into custody around 3 a.m. on other charges and served with the felony warrant shortly after 7 p.m. for failure to register as a sex offender or report an address change, punishable by up to 10 years in prison.

Carter, who also had multiple warrants for failure to appear, was being held on a zero bond and was set to appear Monday in Garland County District Court.

According to the probable cause affidavit, on Sept. 22, Carter, who is classified as a Level 3 or "high risk" sex offender came to the Hot Springs Police Department to register as a sex offender and completed the verification process where he agreed to return no later than Dec. 5, 2020, to again verify his information.

Detective Brian Branstetter noted that Carter failed to appear on Dec. 5 and as of Jan. 11, he still had not come to the department or contacted Branstetter to update his information, 26 days past the required time.

The affidavit notes Carter is a habitual offender of the Sex Offender Registration Act of 1997 because he was arrested on April 17, 2020, May 15, 2020, and on July 21, 2020, for failing to register.

A warrant for his arrest on the latest violation was issued on Jan. 13.
