HOT SPRINGS VILLAGE -- A Hot Springs Village man was arrested early Tuesday on a felony battery charge stemming from allegations he injured his live-in girlfriend with a previous battery charge involving her still pending.

Layton Scott Teague, 28, of 2 Jerez Lane, was taken into custody at his residence shortly after 1:30 a.m. on a charge of second-degree domestic battery, punishable by up to 20 years in prison.

Teague was being held on a zero bond and was set to appear Wednesday in Garland County District Court.

According to court records, Teague lists no prior felony history, but was arrested on Jan. 13 on a misdemeanor charge of third-degree domestic battery involving his girlfriend and a no-contact order was issued. He was released later that day on a $2,500 bond and pleaded not guilty to the charge on Feb. 5 with a review hearing set for Aug. 1.

According to the probable cause affidavit, Hot Springs Village Police Officer Daniel Newton was dispatched to the residence regarding a physical domestic disturbance.

He made contact at the front door with Teague, who stated he had been in an altercation with his girlfriend. Newton reportedly noticed Teague was "under the influence of an intoxicant."

Teague reportedly told Newton "everything was fine" until his girlfriend came home and "tried to give him some McDonald's." When he told her he didn't want it and "threw it away," he says his girlfriend became combative and tried to hit him with a chair.

Teague claims he grabbed her by the arm, which caused a bruise. Newton examined the girlfriend and confirmed there was a bruise on her arm and a red mark under her chin.

Because of Teague's prior arrest for domestic battery involving the same victim and "his intoxicated nature," he was taken into custody and a felony charge was filed.
