A local man was arrested Wednesday on misdemeanor warrants including one stemming from the alleged assault of his live-in girlfriend last month.

Albert Bernard Mitchell, 53, who lists a 948 Whittington Ave. address, was taken into custody shortly after 11:30 a.m. in the 3500 block of Albert Pike Road and charged with third-degree domestic battery and second-degree criminal mischief, each punishable by up to one year in jail.

Mitchell, who also had a zero bond parole hold from the Arkansas Department of Correction, remained in custody with bonds totaling $2,000. He is set to appear Aug. 9 in Garland County District Court.

According to the affidavit on the battery charge, Mitchell's girlfriend alleges that on June 15, around 9:30 p.m., she and Mitchell got into an argument at their Whittington Avenue apartment and he became physically violent.

She said he struck her and slammed her into the front door. She turned around and he struck her again, causing her to fall backward onto her head. She said he then stood over her taunting her and telling her to "get up and get out."

She said she went into the bathroom and then was able to flee the residence. A neighbor told Hot Springs police the victim came to her apartment and collapsed into her arms after she answered the door. The neighbor assisted the victim in reporting the incident and took her to CHI St. Vincent Hot Springs for medical treatment.

The victim provided documentation confirming she was treated for a "closed head injury." The victim continued to experience pain and returned to the hospital June 19 and was diagnosed with a brain concussion.

According to the criminal mischief affidavit, a woman reported that on July 17, shortly after 1 a.m., she saws a known suspect, identified as Mitchell, throw multiple large rocks at her brother's vehicle, causing extensive damage to the windows and body.

According to the affidavit, HSPD Officer R. Nunez was northbound in the 2500 block of Central when he spotted a silver 1997 Toyota 4Runner with a broken taillight ahead of him. A check of the license plate showed the vehicle to have been reported stolen out of Little Rock.

Nunez activated his lights and the vehicle pulled into a parking lot in the 2000 block and stopped. The officer made contact with the driver, identified as Jones, and took him into custody without incident. He was brought in for questioning, but reportedly refused to sign his statement of rights.

The affidavit notes the Blue Book value of the 4Runner to be $1,600. In addition to the theft charge, Jones was cited for driving on a suspended driver's license.
