Man pleads not guilty to felony battery charge

A Hot Springs man accused of assaulting his live-in girlfriend earlier this summer pleaded not guilty to a felony battery charge Friday in Garland County Circuit Court.

Shane Lee Goines, 26, who has remained in custody in lieu of $10,000 bond since his arrest June 9, appeared with his court-appointed attorney, public defender Tim Beckham, and pleaded not guilty to first-degree battery, punishable by up to 20 years in prison.

A disposition hearing is now scheduled for Oct. 9, 2017, in the case. An court order barring Goines from any contact with the victim was also issued Friday.

According to the affidavit, on June 9, shortly before 2 p.m., Hot Springs police Officer Justin Bradbury responded to Goines' residence on Campbell Street regarding a disturbance and made contact with a woman who stated she was in an argument with her live-in boyfriend, identified as Goines, who is also the father of her two children.

She said the argument turned physical when Goines punched her in the face and Bradbury noted she had redness and swelling to her left cheek and under her left eye and a cut to her lower lip. She alleged the injuries were the result of the assault by Goines.

The affidavit notes Goines had two prior convictions for misdemeanor third-degree domestic battery on Nov. 25, 2009, and again on April 16, 2015, both in Garland County District Court.

Under Arkansas law a person is guilty of a felony charge of battery if they commit an act of domestic battery and the person has two previous convictions for the battery against a family or household member within the 10 years preceding the current offense.
