Man arrested for allegedly threatening a family at gunpoint

A Hot Springs man was arrested Friday after allegedly threatening a family at gunpoint outside a local bank.

William David Carr, 53, who lists an Autumn Street address, was taken into custody at 3 p.m. and charged with two counts of aggravated assault, a felony punishable by up to six years in prison. He remained in custody Monday in lieu of $5,000 bond and is set to appear in Garland County District Court Feb. 7.

According to the affidavit, Hot Springs police Officer Rod West responded to Regions Bank, 1555 Malvern Ave., in reference to an assault and made contact with a local man, his wife and child, who said they were walking toward the bank when they heard shouting from the Shell station just down the road.

The couple said they observed a black male in the front passenger seat of a Chrysler Pacifica shouting at them for an unknown reason. As they walked toward the door of the bank, they noted the man appeared to have a handgun.

The father said they entered the bank and a few minutes later he stepped outside to smoke. He said the Chrysler was still in the Shell parking lot, and that the driver, later identified as Carr, got out of the vehicle holding a handgun and began shouting at him, "B - - - - ! You can't hide. I'm going to kill your a - - !" At this time, the man's wife came out to get him and Carr allegedly pointed the gun at them, shouting, "I am going to kill you and your whole family!"

The two went back inside and Carr drove his vehicle to the bank's parking lot, got out of the vehicle with two other black males and attempted to enter, but the bank had locked its doors. From outside the bank, Carr allegedly continued to shout and curse and said, "I know where you live, you can't hide!" Then all three suspects got back in the car and fled north on Malvern, but the victim was able to get the license plate number and give it to police.

Officers located the vehicle at 241 Autumn St. West transported the couple to the scene and they reportedly identified Carr as the man who pointed a handgun at them. A witness said he observed a front-seat passenger in the Chrysler point a handgun at the family and had seen Carr holding a handgun when he exited the vehicle.

West said Carr "became very combative" with officers after being transported to the police department and continued to be uncooperative after he took him to the Garland County Detention Center, where he was placed in a restraint chair.

Derald Keith Powell, 25, was taken into custody around 2:30 p.m. and charged with fourth-degree sexual assault, a felony punishable by up to six years in prison, and harassing communications, a misdemeanor punishable by up to a year in jail. He remained in custody in lieu of a $3,500 bond and is set to appear Feb. 7 in district court.

According to the affidavit, on Dec. 20, a Little Rock woman, 37, reported that a 15-year-old girl had informed her that she had been in a sexual relationship with a known suspect, identified as Powell, and that she had been receiving text messages from him after she ended the relationship, threatening her and another male she had started dating.

The victim showed the text messages to HSPD Detective Patrick Langley, including one that read, "Do you want to break up?" and another that read, "Just tell me then, why don't you love me anymore?", which indicated the two were in a relationship.

When the victim indicated that she wanted to end the relationship, Powell allegedly texted, "You need to get over this s - - - . This is going to end badly for both of us if you continue," and "If I can't have you, no one will." He then asked about her boyfriend, allegedly stating, "He's as good as dead."

During an interview at the Cooper-Anthony Child Advocacy Center on Dec. 21, the victim stated she had sex with Powell twice between Oct. 31 and Nov. 18, 2016, both times at Powell's former apartment on Oriole Street in Hot Springs.
