Man arrested for allegedly assaulting grandmother

A Hot Springs man was arrested Friday morning on a felony battery charge after allegedly assaulting his 76-year-old grandmother after she woke him up.

Justin Edward Terry, 29, of 431 Lake Hamilton Drive, Apt. C-4, was taken into custody at his residence shortly before 8:30 a.m. and charged with second-degree domestic battery, punishable by up to 10 years in prison.

Terry was being held on zero bond and is set to appear Monday in Garland County District Court.

According to the probable cause affidavit, shortly before 7:30 a.m. Friday, the alleged victim called Hot Springs police regarding a battery that had occurred earlier that morning.

She said around 5 a.m., she was attempting to wake her grandson, identified as Terry, so he could go to work. She said he woke up, placed both his hands around her neck and lifted her off the floor.

She said they then walked down the hall toward the kitchen where he punched her on top of the head.

Responding officers noted the victim had redness to her neck area and a scratch on the front of her neck.

Terry was taken into custody at the scene and brought to the police department where he was questioned by detectives and allegedly admitted to grabbing the victim around the neck and striking her on the head.

Under Arkansas law, a person commits felony second-degree battery if they knowingly cause injury to a person who is over 60 years of age or under 12 years of age.
