Man charged with felony battery for alleged attack on mother, 62

A Hot Springs man was arrested early Monday on a felony battery charge stemming from an alleged attack on his 62-year-old mother last month, causing serious injuries.

Duwayne William Harvey, 33, who lists a Longhorn Loop address, was charged with a felony count of second-degree domestic battery, punishable by up to 10 years in prison, and misdemeanor counts of third-degree battery and second-degree terroristic threatening, involving his mother's brother.

Harvey was being held on zero bond and was set to appear Monday in Garland County District Court.

According to the probable cause affidavit, on Sept. 11, Harvey's mother, 62, filed a battery report with the Garland County Sheriff's Department alleging that Harvey, who lives in a separate residence on the same property as her, came into her home and was upset.

She said he was yelling at her and threw her to the floor, injuring her knee. She noted she was unable to get off the floor and required surgery for the injury to her knee.

On Sept. 16, his mother filed for an order of protection against Harvey in district court and provided a more detailed account of the incident. She said Harvey had come in her house saying she "didn't respect him" and was yelling and cursing.

She said he threw a water bottle at her and then broke the kitchen table. She said her husband, Harvey's father, who is in a wheelchair, tried to protect her as Harvey tried to get to her. She said she grabbed her cellphone to call for help, but Harvey grabbed it from her and then threw her to the floor and threw her phone the opposite direction.

She said her husband tried to call for help on his phone, but Harvey grabbed it and destroyed it.

The victim noted she was still on the floor and couldn't move and begged her son to leave, but he refused. She said she crawled over to her husband and they both begged Harvey to leave but he again refused and said he "wasn't going anywhere" and blocked the front door.

The victim said her husband moved to the living room and she crawled after him and was lying on the floor holding on to his wheelchair. She said Harvey continued yelling and cursing at her. At one point, the victim's phone rang and she recognized the ring tone as that of her brother, who also lived on the property.

As Harvey went and retrieved her phone, the victim said she crawled out the door onto her front porch and began yelling to her brother for help. Harvey finally left her residence and went to her brother's house and then went down the hill to his own trailer.

She said her brother came to the residence and they were finally able to call the sheriff's department. The victim was transported by LifeNet to the hospital where it was determined her knee was fractured in the attack.

According to the protection order, she had surgery on Sept. 13 and a plate was put in her knee. She states she has had issues with her son for "the last couple of years" with him coming to her house and threatening her and destroying her property. She noted she was in "imminent fear" of her son because of his actions.
