Sex offender arrested after guilty plea for not registering while still in court

A Level 2 sex offender who pleaded guilty Monday in Garland County Circuit Court to failing to register as a sex offender was arrested again on the same felony charge while still at circuit court.

David Lee Wilson, 51, who now lists a Fairpark Road address in Pearcy, was taken into custody in the courtroom at 501 Ouachita Ave. and charged with failing to comply with sex offender registration and reporting requirements, a felony punishable by up to 10 years in prison.

He remained in custody Tuesday in lieu of $3,500 bond and is set to appear today in Garland County District Court.

Wilson had pleaded guilty Monday to the same charge stemming from his arrest on April 1 and was sentenced to six years in prison, with the entire sentence suspended, fined $1,000 and ordered to pay $190 in court costs.

According to the affidavit on his arrest in April, on Feb. 19, Wilson came to the Hot Springs Police Department to verify his necessary information in compliance with the registration act. Wilson was convicted on Jan. 27, 2014, in Fort Smith of second-degree sexual assault and sentenced to 20 years in prison, with 15 years suspended, and also required to register as a sex offender.

On April 1, Wilson returned to the police department for his 30-day registration verification and stated he had moved to an address in the 300 block of Woodlawn Avenue within the city limits. He stated he had moved there "a couple of weeks ago," without reporting any change of address.

It was later determined Wilson had moved into the residence on Woodlawn at the beginning of February and was residing there on Feb. 19 when he gave police a different address. The affidavit noted Wilson had been living there for 60 days without reporting a change of address.

He was arrested that day and was released on April 20 on a $2,500 bond. He had pleaded not guilty to the charge on June 3 and was then set for a disposition hearing on Monday.

According to the affidavit on Monday's arrest, after Wilson had listed his address as the Woodlawn residence on April 1, he was required to return no later than July 22 to verify his address again. Wilson allegedly failed to return on July 22 and as of Sept. 4 had not returned or updated his information.

On Sept. 4, officers conducted a verification check at his listed address on Woodlawn and discovered the residence was vacant and had neither water or electricity hooked up. A warrant for Wilson's arrest was issued that same day.
