Burglary in progress call leads to arrests

A call about a burglary in progress from a homeowner watching security video of his house while out of town resulted in the arrests of a Lonsdale man and Hot Springs woman Thursday.

Rickey Dale Powell, 43, who lists a Duckhole Trail address in Lonsdale, was taken into custody shortly after noon and charged with felony counts of breaking or entering, possession of a controlled substance, meth, and possession of drug paraphernalia, each punishable by up to six years in prison, and a misdemeanor count of second-degree criminal mischief.

Also arrested was Marsha Jean Avery, 54, who lists a Gibson Street address, on a misdemeanor count of theft by receiving, punishable by up to one year in jail. Powell, who is on parole, was being held on zero bond and Avery was being held on $1,000 bond and both were set to appear Friday in Garland County District Court.

A second man, Thomas Brock Bennett, 43, of Hot Springs, was arrested on a warrant for failure to appear.

According to the probable cause affidavit and incident report, shortly before noon, Garland County sheriff's dispatchers received a call about a burglary in progress at a residence on Promise Land Drive. The homeowner said he was out of town watching on his home security video and saw a white male in black clothing on his property and noted one of his cameras had been disconnected.

Sheriff's investigators and deputies arrived and saw two men, later identified as Powell and Bennett, and one woman, later identified as Avery, attempting to change the tire on a white van in front of the homeowner's residence. The van was found to be registered to Avery.

Deputies went down to the residence to investigate and discovered several cameras had been torn off the house and a storage shed door had been pried open.

At that point, Powell reportedly approached an investigator and stated he had taken the cameras off the house and then pulled one out of his pocket. He was taken into custody and while being patted down, he allegedly admitted he had "some dope" in his pocket and a syringe and a small bag with 1 gram of what later tested positive for meth were recovered.

Avery was found to be a felon with a search waiver on file so her van was searched and deputies reportedly found a weed trimmer, gas can and ax that the homeowner later identified as coming from his shed.

Powell reportedly admitted he broke into the shed and took the items resulting in the additional charges against him. Avery was also charged since the items were in her van, but Bennett was not charged in connection with the burglary.
